Swiss law student challenge; heuristics and law



























Consider the following, true-false
questions. How many can you answer correctly, based on theoretical knowledge of
Swiss law?



a)
an accuser need not answer questions
by the defence, before or at trial;

b)
the prosecution need not appear
at trial;

c)
the judge can substitute for
the prosecution, accusing the defendant of a crime not charged by the district
attorney;

d)
a defence lawyer can withdraw
from a case just prior to trial, conceal defence evidence, and threaten his own
client with “punishment” if he refuses an out of court settlement.



The answer to all of the above in practice
is “True.”



The explanation? The legal system is subject to
heuristics. Swiss law student or psych-,
sociology grad student with well-developed German writing skills sought to
co-develop a compendium of heuristics that apply to the legal system in
Switzerland, explaining how theoretical law is supplanted by psychology and
corruption.
